So Toto sent an email depicting the FIA rule that they should take into consideration. Lewis was in the middle of his attempt to pass when Max turned in. Horner on the other hand called Masi to stamp his feet to say it was all Lewis' fault, he didn't stop to think about all the similar occasions that Max has been in the middle of due to his driving style.
