Max got the message first after RB got it from the FiA, give up the position or a penalty. At the time of the accident Han did not know. He should have known first. RB crafted a strategy: hold Ham off until the DRS line, that is why he slowed, sped up, a few times, trying to set up Ham passing him right before the line, and Max well within a second and getting DRS.
